JELD-WEN will appeal a court ruling and underlying judgment in a litigation dispute with Steves & Sons, Inc., the company said in a press release Thursday.
A court has ruled that JELD-WEN was in violation of antitrust laws or breach of contract and awarded Steves & Sons $7 million as a follow-on to last year’s verdict.
JELD-WEN said the rulings were “fundamentally incorrect.”
The company said that the court excluded evidence of Steves’ alleged theft of JELD-WEN’s trade secrets from the antitrust/breach of contract trial and two investigations done by the Antitrust Division of the Department of Justice. Both investigations were closed and no action was taken against JELD-WEN.
The underlying judgment appeal has made it to briefing and awaits oral argument, JELD-WEN said.
Steves & Sons, Inc., a Virginia-based door manufacturer has been in disputes with JELD-WEN since 2018.
“All of us look forward to returning competition and choice to this industry – not just to Steves, but to the other independent door manufacturers around this country who are have no sourcing choices due to an adjudicated antitrust violation,” said Sam Bell Steves, president of Steves & Sons.
Despite the court proceedings, Gary Michel, president and CEO of JELD-WEN remains positive.
“This case has not – and will not – shift our focus away from delivering for our customers,” he said.
JELD-WEN is a door and window manufacturer based in Charlotte. Shares of JELD-WEN closed at $20.42 on Friday, down 18 cents.
